Mandatory Designation Disclosure Requirement Proposed in NJ
The New Jersey Division of Consumer Affairs is considering a proposal to require charities in their oral or written solicitations to disclose to donors that they have the right to designate their donations to a specific fund or activity mentioned in the solicitation. While some organizations already provide donors with such designation options as standard practice, the proposed New Jersey mandate raises significant constitutional questions about “required speech,” as well concerns over administrative costs and burdens. The Center for Non-Profits in New Jersey and the National Council of Nonprofits have submitted comments in opposition to the proposal.
